End User License Agreement (EULA) & Terms and Conditions

Welcome to Keteke ("we", "our", "us", or "Company"). These Terms and Conditions and End User License Agreement ("Agreement") govern your access to and use of the Keteke website (https://keteke.net), the Keteke mobile applications on Apple iOS (App Store) and Android (Google Play), and any associated services, marketplace features, and directory listings (collectively, the "Platform").

BY DOWNLOADING, INSTALLING, REGISTERING AN ACCOUNT, OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.

1. Scope of License (Apple & Android App Users)

Keteke grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Keteke Mobile Application for personal and business purposes on compatible devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and Google Play Terms of Service.

  • You may not modify, reverse engineer, decompile, or create derivative works of the application.
  • You acknowledge that this Agreement is concluded between you and Keteke only, and not with Apple Inc. or Google LLC. Keteke is solely responsible for the application and its content.
  • Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

2. User Accounts & User Roles

To access certain features of the Platform, you must register for an account. We provide different account types:

  • User / Buyer: Allows you to browse directory listings, search services, submit reviews, and purchase products from marketplace sellers.
  • Service Provider: Allows you to list professional services, trades, consulting, or rent out residential/commercial properties and homes to clients or tenants.
  • Business Owner: Allows you to list registered storefronts, restaurants, offices, or commercial business profiles in the Keteke Directory.
  • Seller / Vendor: Allows you to list, market, and sell physical goods or marketplace merchandise to customers.

You agree to provide accurate, truthful, and complete information during registration and keep your profile updated. You are solely responsible for maintaining the confidentiality of your account credentials.

3. User-Generated Content (UGC) & Zero-Tolerance Moderation Policy

Keteke allows users, service providers, business owners, and sellers to submit listings, product images, reviews, ratings, inquiries, and messages ("User Content").

Zero Tolerance for Objectionable Content and Abusive Users:
Keteke strictly prohibits any content that is defamatory, offensive, hateful, sexually explicit, fraudulent, infringing on intellectual property, harassing, or otherwise unlawful. In compliance with Apple App Store and Google Play safety standards:

  • No Objectionable Content: You may not upload, post, or distribute abusive, discriminatory, obscene, threatening, or illegal material.
  • Content Moderation: Keteke reserves the right to review, edit, reject, or permanently delete any listing, review, message, or user account that violates these terms.
  • Reporting & Flagging: Users can report objectionable listings, products, or reviews. Keteke acts upon reported content within 24 hours by removing offending content and ejecting the responsible user.
  • Blocking & Deletion: Any user or seller engaging in abusive behavior, fraud, or spam will be immediately suspended or permanently banned from the Platform.

4. Marketplace Purchases, Payments & Vendor Payouts

  • Payment Processing: All credit/debit card transactions on Keteke are processed securely via Stripe. By making a purchase, you authorize our third-party payment processors to charge your selected payment method.
  • Vendor Sales: Marketplace Sellers and Service Providers receive payouts via Stripe Connect or designated manual bank transfers after deducting applicable platform commission fees.
  • Pricing & Availability: All prices, shipping charges, and item specifications are set by individual sellers. Keteke is not liable for price inaccuracies or inventory stockouts caused by third-party sellers.
  • Order Cancellation & Refunds: Refund requests and dispute resolutions are handled in accordance with individual vendor return policies and applicable consumer protection laws.

5. Property Rental & Service Provider Listings

If you register as a Service Provider to list a property for rent, home rental, or professional service:

  • You represent and warrant that you are the legal owner, landlord, or authorized agent with full rights to offer the property or service for rent.
  • You are solely responsible for ensuring your rental listing complies with all local zoning, housing, tenancy, safety, and tax regulations.
  • Keteke serves as a discovery and communication directory and is not a party to any rental agreements, lease contracts, or real estate transactions executed between landlords and tenants.

6. Intellectual Property Rights

The Keteke name, logo, software, trademarks, website design, graphics, and code are the exclusive intellectual property of Keteke and its licensors. You agree not to copy, scrape, distribute, or exploit any part of our platform without prior written consent.

7. Limitation of Liability & Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

  • Keteke does not guarantee the quality, safety, legality, or punctuality of items, services, or rental properties provided by third-party sellers or providers.
  • To the maximum extent permitted by applicable law, Keteke shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of the Platform.

8. Apple & Google Third-Party Beneficiary Rights

You acknowledge and agree that Apple Inc. and Apple's subsidiaries, as well as Google LLC, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

9. Account Deletion & Termination

You may request the deletion of your account at any time through your profile settings or by contacting our support team. Keteke reserves the right to suspend or terminate accounts that violate this Agreement, commit fraud, or disrupt marketplace safety.
